EcoWave reserves the right to revise or amend these Terms at any time without prior notice. The Terms applicable to your order or Website use will be those displayed on the Website at that specific time. Your continued use of the Website following any changes will be deemed as acceptance of the updated terms.

2. Intellectual Property Rights

All content on the myecowave.com Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, as well as all trademarks, service marks, trade names, and designs displayed, are owned by or licensed to EcoWave and are protected by New Zealand and international copyright, trademark, and other intellectual property laws. Nothing on this Website should be construed as granting any license or right to use any trademark or logo displayed without the express written permission of EcoWave. You are prohibited from copying, reproducing, republishing, uploading, posting, communicating, transmitting, or distributing any Website content for public or commercial purposes without the express written permission of EcoWave. Where EcoWave permits users to submit content (e.g., reviews, comments), by submitting such content, you grant EcoWave an irrevocable, sub-licensable, and unrestricted license to exploit such submissions.

3. Product Information and Availability

EcoWave strives to ensure that all product descriptions, images, and pricing are accurate and up-to-date. While reasonable efforts are made to display product colours accurately, the actual colour seen by you may vary depending on your system configuration, and EcoWave cannot guarantee precise colour representation. Any claims regarding product availability and estimated delivery times are accurate and based on a reasonable belief that EcoWave can supply the goods on the terms offered. EcoWave reserves the right to discontinue any product at any time and to correct any errors on the Website, including pricing errors, prior to dispatch. Environmental Claims: All environmental claims made about EcoWave products, such as "eco-friendly," "zero waste," or "removes 99% of impurities," are specific, truthful, accurate, and substantiated by credible evidence. We avoid vague terms unless backed by specific, detailed, and verifiable facts. Claims relate to the complete product life cycle (manufacture, distribution, use, disposal) unless otherwise stated, and do not overstate positive impacts or understate negative ones. Any use of third-party certifications or eco-labels is accurate and does not overstate the environmental benefit.

4. Pricing and Payment

All prices on myecowave.com are stated in New Zealand Dollars (NZD). Prices displayed include Goods and Services Tax (GST) unless explicitly stated otherwise. EcoWave is committed to keeping payments secure, utilizing measures such as SSL (Secure Sockets Layer) certificates for its Website to encrypt sensitive data like credit card numbers. Accepted payment methods will be listed on the Website. An order confirmation sent to you does not constitute acceptance of your order. EcoWave reserves the right to accept or decline an order for any reason, including, but not limited to, stock depletion or inaccuracies in product information, even after payment has been processed. If an order is declined or cancelled after payment, a prompt refund will be issued to the original payment method. Any product specials advertised on the day an order is placed will be honoured, regardless of the order pickup date. All representations about price, including discounts or comparisons, are clear, accurate, and unambiguous, and we do not exaggerate price discounts.

5. Order Acceptance and Cancellation

EcoWave retains the sole discretion to accept or decline any order for any reason, including, but not limited to, stock depletion or inaccuracies in product information. While an order confirmation will be sent upon receipt, this communication does not signify acceptance of the order. If an order is declined or cancelled by EcoWave after payment has been processed, a full refund will be promptly issued to the original payment method used for the purchase.

6. Delivery and Shipping

EcoWave offers various delivery methods, including direct delivery by courier services. Clear information regarding shipping costs, applicable taxes, additional fees, and estimated delivery times will be provided to you. You are responsible for providing accurate contact details and a correct delivery address where deliveries can be made during standard working hours (Monday to Friday). A signature may be required upon receipt, and deliveries typically cannot be made to PO box numbers. If an order is not delivered according to the provided information, you should contact the courier's customer support with the tracking number, or EcoWave if a tracking number is not received or is incorrect. EcoWave aims to deliver within a specified timeframe (e.g., five working days), but acknowledges that delivery may occasionally take longer. If delivery exceeds a reasonable period (e.g., 20 working days), you reserve the right to cancel your order. For international shipping, you are explicitly responsible for paying any import charges, customs duties, and taxes (such as VAT) that are not included in the Website prices, and EcoWave advises you to contact your local customs authority for more information on these fees. If an order cannot be fulfilled due to reasons attributable to you (e.g., incorrect address, inability to reach recipient, non-payment of charges/duties/taxes), and the products are not returned to EcoWave, we reserve the right to retain the full amount paid. If products are returned under such circumstances, an administrative fee may be charged. EcoWave's delivery terms explicitly comply with the Consumer Guarantees Act 1993 (CGA), which guarantees that goods will be received by the consumer at an agreed time or within a reasonable time if no time is agreed, and that they will arrive in good condition. Click & Collect: If you choose our Click & Collect service, you place your order online and collect it from our specified store location. You will be notified via email when your order is ready for collection. You are expected to collect your order within 2 weeks, but you may contact the store directly to extend this period if needed. Photo identification (such as a New Zealand driver's licence, Passport, or 18+ card) will be required for collection. Someone else may collect on your behalf if they present the order confirmation and their own photo ID. For additional security, first-time collectors may be asked to show ID and the payment card used for the purchase. If items purchased via Click & Collect are damaged, faulty, or spoiled at the time of pickup, EcoWave will comply with its obligations under the Consumer Guarantees Act 1993.

7. Returns, Refunds, and Warranties

EcoWave's return policy operates in full compliance with the Consumer Guarantees Act 1993 (CGA), which grants consumers rights to repair, replacement, or refund for faulty products or services. Our return policy specifies a timeframe for returns (e.g., 30 days from delivery), requiring goods to be returned undamaged, in full working order (unless a manufacturing fault exists), in their original packaging, and with the original proof of purchase. You may be held liable for any decrease in the product's value resulting from handling beyond what is necessary to establish its nature, characteristics, and functioning. Certain exclusions may apply, such as products with broken seals that cannot be returned for health or hygiene reasons, or personalized items, unless a right to return exists under the CGA. To initiate a return, you should contact EcoWave's customer service via the specified channels (e.g., email) to arrange shipment. The policy will clarify who bears the cost of return shipping. Refunds for eligible returns will be processed within a reasonable timeframe (e.g., 14 days) using the same payment method as the original purchase, unless otherwise agreed. For products received damaged or defective, you should contact EcoWave as soon as possible, providing photos of the damage or defect. EcoWave will then, at its discretion, offer a replacement, repair, or full refund, in accordance with CGA obligations. Information on any manufacturer's warranties accompanying products will also be provided. It is critical to reiterate that EcoWave's return policy is provided in addition to or consistent with the non-excludable rights granted to consumers under the CGA, and does not seek to replace or diminish them.

8. User Conduct and Prohibited Activities

You agree to comply with all applicable laws while using the Website. Prohibited activities include, but are not limited to: Infringing the privacy rights of any user. Using the Website in a manner that harms EcoWave or its related entities, partners, or suppliers. Misleading any user or supplying false data. Sending unsolicited bulk messages, commercial messages, or any form of spam. Attempting to modify or reroute the Website without authorization. Damaging, disabling, overburdening, or impairing the Website or interfering with others' use. Reselling or redistributing any part of EcoWave's services. Uploading or transmitting malicious software. Engaging in harassment or defamation. Attempting to exclude competitors from using the Website's features. You are responsible for maintaining the confidentiality of your account login information and are fully accountable for all activities occurring under your account. You must immediately notify EcoWave of any unauthorised use or suspected security breaches related to your account. EcoWave reserves the right to suspend or terminate user accounts that violate these terms.

9. Disclaimers and Limitation of Liability

While EcoWave strives for accuracy, it cannot guarantee that the Website content is free from errors or viruses, and users are advised to maintain updated virus protection software. EcoWave disclaims liability for issues arising from product misuse, asserting that any use of products outside their intended purpose is the sole responsibility of the customer. Furthermore, EcoWave will not be liable for any special, indirect, or consequential loss or damage, such as loss of revenue or data, suffered in connection with the Website, regardless of whether that liability arises under contract, tort (including negligence), or statute. Crucially, these limitations on liability do not apply to the extent they are inconsistent with New Zealand consumer law, particularly the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. This means that these disclaimers cannot override statutory rights that are non-excludable by law. The purpose of these disclaimers is to clarify the scope and limitations of EcoWave's offerings and responsibilities, not to provide absolute exemption from liabilities mandated by consumer protection legislation. EcoWave also disclaims responsibility or liability for the availability or accuracy of any third-party links or resources, or for the content, products, or services available from such external websites.

10. Dispute Resolution

In the event of a complaint or issue, you are encouraged to initially contact EcoWave directly to seek a resolution. EcoWave will provide clear instructions on how you can submit complaints (e.g., via email). If a satisfactory resolution cannot be reached directly with EcoWave, you may consider making a claim at the New Zealand Disputes Tribunal, which offers an accessible forum for resolving consumer disputes. The relationship between EcoWave and its users is governed by the laws in force in New Zealand. Furthermore, users irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New Zealand for the resolution of any disputes.

11. Changes to Terms and Conditions

EcoWave reserves the right to revise or amend these Terms and Conditions at any time without prior notice. The terms and conditions that will apply to your order or use of the Website will be those published on the Website at the specific time the order is placed or the Website is accessed. Your continued use of the myecowave.com Website following the publication of any changes will be deemed as acceptance of the updated or amended Terms and Conditions. If you do not agree to the changes, you should cease using the Website.

3. Sharing and Disclosure of Personal Information

Personal data may be shared with trusted service providers who perform functions on EcoWave's behalf, such as payment gateways, cloud hosting providers, analytics services, shipping companies, and marketing automation platforms. These third parties are contractually bound to protect the information and use it only for the purposes for which it was provided. Personal information may also be disclosed to EcoWave's internal staff as appropriate for business operations. Disclosure may also occur where required or permitted by law, such as to comply with legal processes, respond to requests from public and government authorities, or to investigate a complaint. EcoWave explicitly states that it does not sell or otherwise provide personal details to third-party marketing companies for their direct marketing purposes without your specific consent. This Privacy Policy will identify the countries where data may be transferred (e.g., if cloud servers are located overseas). We will also outline the safeguards implemented, such as contractual clauses, to ensure the protection of personal information during cross-border transfers.

5. Storage and Security of Personal Information

EcoWave is committed to protecting the personal information it collects. We implement appropriate security measures to safeguard collected personal information from loss, unauthorized access, use, modification, or disclosure, and other misuse. These measures include both physical and digital safeguards, such as securing storage of physical records, utilizing cybersecurity measures like firewalls, anti-virus software, two-step authentication sign-ins, and email/messaging encryption, as well as performing regular risk assessments and updating security protocols. Administrative procedures, such as limiting access to sensitive customer records to authorized senior staff with individual keys or passwords, are also in place. While EcoWave takes all reasonable steps to protect information transmitted over the internet, we acknowledge that no method of transmission or storage is 100% secure, and therefore cannot guarantee absolute security. You engage with the Website at your own risk. EcoWave will retain personal information only for as long as necessary to fulfill the purposes for which it was collected or as required by law.
